Guest Barbie4sale Posted May 25, 2011 Posted May 25, 2011 BC LouE reply to bojoward in the Pinch of platinum on Ebay - how does someone get 4 dolls BC LouE: "Unfortunately, there isn't anything 'against the rules' here... members are free to do what they want with their dolls once they purchase them. " Am I reading Rule 10 wrong? It's only fair that we know the true meaning of Rule 10 There's seems to be a lot of chatter with each BFC platinum doll. I'm thinking many members are under the impression #10 means you agreed to not sell the Doll before you have it in hand? Please clarify as soon as possible Thanks cher 10. Prohibition Against Pre-Selling Mattel Online Exclusive Products Pre-selling (defined below) a Mattel online exclusive item (i.e. an item that Mattel sells exclusively online), including items that may be obtained with or without Mattel's permission, is expressly prohibited. "Pre-selling" means listing or advertising (either directly or through a third party) a Mattel online exclusive item prior to the date that Mattel delivers the product to you. You agree not to participate in any way in such an activity; any attempt to do so may result in, among other things, the immediate termination of your membership, without refund, reimbursement, or credit of your Membership Fees.
Guest BC Jodie Posted May 25, 2011 Posted May 25, 2011 Hi Cher! Thanks for your post. To clarify, yes, Rule 10 in the membership agreement is correct, to the letter. We are aware of the chatter, and as previously stated on the boards, all ebay listings that were posted on ebay before the beginning of the Platinum sale have been turned over to our legal department for review. However, to Lou's point, once a member purchases a doll and receives it (sorry if the message was muddled), he/she is allowed to do whatever he/she wants to do with it, be it keep it, debox it, or sell it on ebay. So no selling the doll until you have the doll in hand. Thanks for the opportunity to clarify this. We here at BC have posted the rules, we reiterate the rules every year, in hopes that members will honor them in good faith, and every year, 99% of the fan base honors those rules. A small portion does not. We're sorry that you're disappointed by this behavior - frankly, we're disappointed, too. We agree that this behavior is not fair - to reiterate, all listings that were posted on ebay before the sale have been forwarded to legal. Thanks again for your post, and have a great day! BC Jodie
Guest BCLouE1572382628 Posted May 25, 2011 Posted May 25, 2011 you're right, I mispoke. Members are free to do what they want with the dolls once they recieve them. And the ebay sellers that have the doll listed now are technically breaking the rules by posting these sales before they've received the dolls. My apologies for the confusion. As for this violation, we take action when we are able, and we work with our legal team and ebay to identify members that violate the agreement. We have sales removed from ebay when we are able, but there are specific requirements that must be met that allow us to make that request to eBay (requirements that I won't go into here, as I don't want to tell people how to get around us on this). When we're able to conclusively identify an eBay seller as a BFC member, their membership, and any related membership, is cancelled. But again, identifying members that violate these rules is not a simple thing, so sometimes we are not able to take any action. It does not mean we are ignoring the issue, only that we do what we are able within the constraints under which we must operate. thank you.
